The Alternatives for Dispute Resolution Committee circulated to all
State and Province Chairs last year a questionnaire on local mediation
practices and procedures. The survey focused on mediation defined as the
use of a professionally trained person to assist the parties to a
dispute in arriving at a voluntary settlement of their controversy.
Although mediation programs vary and many trial lawyers feel a sense
of caution about their efficacy, the survey found that mediation is an
established, generally favored, and growing means of alternative dispute
resolution. It should be considered what it is — another
alternative weapon in the arsenal of the skilled advocate.
